4) The major hurdle — big shock — the US is not party to subject to the Rome Convention element from what I understand. So — it would be a challenge for the ICC to simply issue its own arrest warrant. This is where it gets complicated. But in theory, if the crime occurs in a jurisdiction where the Rome convention is recognized, then yes, they could effectively issue a warrant upon a completed investigation. l
5) If such a warrant was issued, he could — in theory — be arrested and detained by the ICC if he leaves the USA and sets foot in pretty much all of the EU, Canada, many African states. But again — the US is not part of the ICC and now we see why. The UN Security Council could als step in here and make a referral but the US would likely veto it.
Bottom line — our own people would have to drag his ass to the ICC for justice in this situation because the US never really agreed to be part of the ICC and to me — that is part of the crime.
My bigger fear — he has talked about and seems to be a little bit desperate to use nuclear weapons. If the military doesn't refuse — and we know his cabinet of sycophants and cult members and enablers in congress will never hold him accountable — what stops him? And my belief — in my core — he wants to do it. He doesn't care care if he is remembered as a hateful monster.
